These Terms & Conditions (“Terms”) govern your use of theartifact.ca and the purchase of digital products sold under The Artifact, a product brand operated by StudioM2 (“we,” “us,” or “our”).

By accessing this website or purchasing any product, you agree to be bound by these Terms. If you do not agree, please do not use this website or purchase our products.

1. Products and Services

The Artifact offers digital landscape design plans and kits created specifically for Alberta residential front yards. All products are delivered digitally. No physical goods or on-site services are provided unless explicitly stated in writing.

2. Digital Product Delivery

Upon successful payment:

• you will receive access to download the digital product(s)

• delivery is typically immediate or via email

• it is your responsibility to ensure your email address is entered correctly

3. Guarantee & Refund Policy

Your purchase is backed by The Artifact Guarantee, as described on our website.

a) Our Guarantee

We guarantee that:

• the digital product delivered is complete and professionally designed

• the files are accessible, functional, and usable

• the product reasonably matches the description provided on the sales page

• the design has been created with Alberta climate considerations in mind

b) Satisfaction-Based Refunds (Limited)

If, after reviewing the digital materials, you believe the product does not reasonably match what was described, you may request a refund within 7 days of purchase, subject to the following conditions:

• you must contact us at james@theartifact.ca within 7 days of purchase

• your request must include your order number and a brief explanation

• the request must relate to the product content itself, not installation outcomes

If approved, a full refund will be issued to the original payment method.

c) Exclusions

Refunds will not be issued for:

• change of mind after purchase

• personal preference or aesthetic taste

• installation errors or contractor work

• site-specific conditions (soil, grading, drainage, sun exposure)

• extreme or unusual weather events

• plant availability or substitutions

• failure to follow the provided plan

Landscape outcomes depend on many variables beyond our control.

d) Technical Issues

If you experience a technical issue (missing files, corrupted downloads, access problems), we will:

• provide a corrected or replacement file, or

• issue a refund if the issue cannot be resolved within a reasonable time

e) License Revocation Upon Refund

If a refund is issued, your license to use the digital materials is immediately revoked, and you must delete all copies of the product.

4. Intended Use & Disclaimer

All products are provided for educational and informational purposes only.

You are responsible for:

• verifying local bylaws, permits, and utility locations

• confirming plant availability and substitutions

• ensuring proper installation and maintenance

We do not guarantee specific results or outcomes once a plan is implemented.

5. Intellectual Property & License

All content, designs, drawings, plans, text, graphics, and materials provided through The Artifact are the intellectual property of StudioM2.

Upon purchase, you are granted a limited, non-transferable license to:

• use the product for one residential property

• print copies for personal use

You may not:

• resell, redistribute, or share the files

• use the designs for commercial or multi-property projects

• reproduce or modify the content for resale

Unauthorized use is strictly prohibited.

6. User Conduct

You agree not to:

• misuse or copy our content

• attempt to access restricted areas of the website

• use the website or products for unlawful purposes

We reserve the right to restrict access or refuse service if these Terms are violated.

7. Payments

All payments are processed securely through Stripe.

We do not store your payment details.

By completing a purchase, you authorize Stripe to charge your selected payment method.

8. Limitation of Liability

To the fullest extent permitted by law:

• The Artifact and StudioM2 shall not be liable for any direct, indirect, incidental, or consequential damages arising from the use of our products or website

• this includes property damage, financial loss, plant failure, or installation outcomes

9. Chargebacks & Disputes

We encourage customers to contact us first if an issue arises.

Initiating a chargeback without first contacting us may result in:

• revocation of product access

• restriction from future purchases

We reserve the right to contest chargebacks where delivery and acceptance of these Terms can be demonstrated.

10. Governing Law

These Terms are governed by the laws of the Province of Alberta and the laws of Canada applicable therein.

Any disputes shall be resolved exclusively in Alberta courts.

11. Changes to These Terms

We may update these Terms from time to time.

The most current version will always be posted on this page with an updated “Last updated” date.
